Online Shopping Terms and Conditions
1. General Terms
1.1. In these Online Shopping Terms and Conditions and G.M. Collin HK Special Terms (as defined below) (collectively, “these Terms and Conditions”), “G.M. Collin”, “we”, “us” or “our” refers to G.M. Collin HK business, and “Customer” or “you” refers to any individual, organization or company who orders goods or services from us. Please read these Terms and Conditions carefully before using this website or our application (collectively referred to as the "E-Store"). By using the e-Store or any part thereof, you agree that you have read these Terms and Conditions and accept and agree to be bound by them.
1.2. We will make every effort to ensure that the prices, information and sizes of the products listed on the e-store are updated. We reserve the right to change the prices of goods without prior notice. All orders are subject to acceptance at our sole discretion and subject to stock availability.
1.3. We will make every effort to ensure that the products listed on the e-shop are in stock. If any product is unavailable to customers due to out of stock, we have the right to offer a substitute product of the same type and price.
1.4. All orders are subject to final confirmation depending on the availability of the relevant goods. If we are unable to provide any products or services ordered, we reserve the right to refuse to accept the order.
2. User Registration
2.1. You must register as our user (online or otherwise) before you can order goods or services on the e-shop. When you register, you promise that:
• Provide true, accurate, current and complete information about yourself as requested;
• You must ensure that your username and password are kept secure;
• Only you or someone authorized by you may log into the e-store using your username and password;
• We have the absolute discretion to reject any new user application and terminate any registered user without providing any reason.
2.2. If there are any changes to your registered information, you may log in to your account to update or notify G.M. Collin HK Customer Service Department immediately by phone or email to ensure that we can provide you with the latest information.
3. Privacy protection
In order to protect your privacy rights in respect of your personal data, we ensure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the provisions of the Personal Data (Privacy) Ordinance (Chapter 486) of the Laws of Hong Kong.
4. Others
4.1. Basis of supply: We sell and deliver products only to end consumers. We do not sell our products for resale. If we have reasonable grounds to believe that you are purchasing our products for purposes other than your own use, we have the right to refuse or cancel your order.
4.2. Force Majeure: If we are unable to accurately provide the products or services you require due to force majeure (including natural disasters, fire, flood, accidents, riots, war, government policies, embargoes, strikes, labor difficulties, equipment failure or any circumstances beyond our control), we will not be liable to users or any third party.
4.3. You may not assign, transfer or otherwise transfer any of your rights and obligations under these Terms and Conditions to any other person without our prior written consent.
4.4. If any provision of these Terms and Conditions is deemed to be illegal or invalid, such provision will be deleted and will not affect the legality, validity and enforceability of the remaining provisions of these Terms and Conditions.
4.5. These Terms and Conditions contain the entire agreement between the parties and supersede all prior negotiations, representations, understandings and agreements.
4.6. We have the right to amend, modify or supplement all or any of the terms and conditions at any time by notifying you in advance.
4.7. In case of any disputes, we reserve the right to make the final decision. The Chinese translation of these Terms and Conditions is for reference only. In the event of any discrepancy between the Chinese and English versions, the English original shall prevail.
4.8. These Terms and Conditions will be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China and you and we are subject to the jurisdiction of the Hong Kong courts. We may amend or modify these Terms and Conditions from time to time without prior notice to you.
